Welcome to the Spotix platform ("the Platform" or "the App"). The Platform provides a system for creating and participating in interactive experiences, tours, and location-based puzzle games. Use of the Platform is subject to the terms outlined below. By accessing, registering, or participating in any activity, you fully accept these terms.
This document complements our Privacy Policy, available at spotix.app/en/privacy.
1. Platform Operator

2. User Types and License to Use
The Platform serves two types of users:
Creators: Registered users with an administrative account, authorized to create and manage tours and create access codes using credits. Creators are granted a limited, personal, and non-transferable license to use the management system (CMS).
Players: Users who join activities anonymously via an access code, without the need to create an account.
3. Minimum Age and Parental Consent
Creators may only register if they are 18 years or older. Registration by a minor requires written consent from a parent or guardian.
Players may participate in activities even if they are minors, subject to the following conditions:
- Participation by children under the age of 16 requires consent from a parent or guardian, in accordance with GDPR Article 8 and Israel's Privacy Protection Law.
- The responsibility to obtain such consent and to supervise the minor's participation in the game (including media uploads) lies with the tour creator (the educational institution, organization, or parent).
- Since the game includes photo missions and media uploads to a public address, explicit parental consent for the terms of sharing in a public space is required.
For users in the United States, our platform complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13.
4. Physical Safety and Limitation of Liability
Spotix activities take place in the real, physical world.
Your participation in any activity is at your sole responsibility. You must comply with the law, observe traffic regulations, and avoid entering private or hazardous areas. Spotix shall not be liable for any bodily harm, injury, loss, or property damage (including damage to mobile devices) caused during an activity. The map and navigation components in the App are provided as gameplay aids only and do not constitute a formal safety or wayfinding tool.
5. Security and Recovery Questions (Player Notice)
To enable access recovery for a team from another device, the Platform requires players to enter a "security question" and answer.
It is hereby clarified that the answer is stored in the database in plain text. It is strictly prohibited to enter personal passwords used by you for other services (such as email or banking), ID numbers, or payment information. Responsibility for the leakage of sensitive information entered in violation of this guideline lies solely with the user.
6. Media Uploads (User-Generated Content) and Platform Liability
During gameplay, players may upload photos, videos, and audio recordings (UGC).
Public Visibility: Any media file uploaded to the Platform is stored at a public URL (media.spotix.app) and is accessible to anyone with the link. Content containing sensitive information or images of people without their consent must not be uploaded.
Limitation of Liability: Spotix serves as a hosting platform only. Sole responsibility for media content, including copyright, defamation, or privacy violations, lies with the user who uploaded the content and with the tour creator (who has the ability to manage and delete content in the feed).
Notice and Takedown Procedure: We operate under a "notice and takedown" procedure and will remove infringing content upon receipt of a proper report at [email protected].
DMCA Compliance (United States): For copyright infringement claims under the U.S. Digital Millennium Copyright Act, please send a written notice to [email protected] with: a description of the copyrighted work, the infringing URL, your contact information, a statement of good faith belief, and your signature.
7. Shared Media Gallery
Tour creators may create a public gallery link displaying media files uploaded by players. The gallery is openly viewable without registration.
When downloading a file from the gallery, the user is prompted to enter an email address. The email is used to send a one-time email with the gallery link. If the user has explicitly opted in to receive updates, their email address will be shared with the tour creator for mailing list purposes.
Gallery share links expire after 7 days from creation.
8. Creator Content and Copyright
Ownership: All content uploaded by a tour creator to the Platform, including text, images, audio files, video, puzzles, and questions, remains the creator's full and exclusive property.
Warranties and Responsibility: The tour creator represents and warrants that all content uploaded to the Platform is owned by them or that they have all the necessary rights, licenses, and permissions to upload it, including copyrights, performers' rights, and privacy rights of individuals appearing in the content.
Indemnification: In the event of a claim or third-party demand against Spotix in connection with a tour creator's content, the creator undertakes to indemnify Spotix for any damages, expenses, or costs (including legal fees) incurred.
9. Intellectual Property in the Platform
All intellectual property rights in the Platform, including code, design, structure, algorithms, block types, user interface, and any future development, are the exclusive property of Spotix.
This agreement grants a limited, non-exclusive, and non-transferable license to use the Platform.
It is prohibited to use the Platform for unauthorized purposes, distribute it, copy its code, perform reverse engineering, or grant a sublicense to a third party.
10. Changes and Service Termination
We reserve the right to block users, delete activities, or terminate the service at any time in case of misuse or violation of these terms, without obligation to compensate.
11. Limitation of Liability and Service Availability
The Platform is provided "As-Is," without any commitment to continuous availability or fault-free operation.
Spotix relies on infrastructure services from leading third parties (Cloudflare, Supabase, Mapbox, and others), as detailed in the Privacy Policy. Disruptions in these infrastructures are beyond our control.
Spotix shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Platform, including data loss, delays, bugs, service outages, lost revenue, or reputational harm.
Specific agreements with institutional clients may include specific SLA terms that shall override the provisions of this section.
12. Changes to Interface and Functionality
Spotix is an evolving platform that is updated on an ongoing basis. We reserve the right to change the system's structure, design, features, and content scope. Significant changes that may affect the manner of use will be announced in advance through official channels.
13. Artificial Intelligence (AI) Usage
Tour creators may use a built-in AI assistant for automatic translation and content creation assistance. Use of the AI assistant is at the creator's discretion (Opt-In). Full details on data handling are available in the Privacy Policy, Section 7.
14. Third-Party Services
The Platform uses external services as detailed in the Privacy Policy. These services are subject to the terms of service and privacy policies of their respective providers. Spotix is not responsible for their availability, security, or any damage arising from their use.
15. Data Processing Agreement (DPA) for Institutions
Organizations and institutions required to sign a standard DPA can access our Data Processing Agreement or contact us at [email protected] for a customized version.
16. Changes to These Terms
We reserve the right to update these terms from time to time, at our discretion, including to comply with legal, technological, or operational requirements. Updated terms shall take effect upon publication. Continued use of the Platform after the update of terms constitutes acceptance of the updated version.
17. Governing Law and Jurisdiction
These terms shall be governed by the laws of the State of Israel only. The exclusive jurisdiction for any matter relating to these terms or use of the Platform is granted to the competent courts in the Haifa District, Israel.
18. Severability
If any provision of these terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full effect.
